Probate Explained

Probate is the court process by which a last will and testament (if there is a will) is determined to be valid, and the court approves the appointment of the person or institution named in the will to administer the estate (the Executor). If there is not a will, the probate court will move forward, by application of an interested party, to appoint an administrator who will distribute the estate of the deceased.
